The Law

Can we play poker in our venue?

Yes, the Gambling Act 2005 allows equal chance gaming (including poker) in pubs, but introduces strict conditions for any gaming, including limits on stakes and prizes, and provides licensing authorities with powers to take action against individual premises in a range of circumstances.

The Regulations set a fixed limit of £5 per game on the amount that may be staked by a player in any type of equal chance gaming in pubs and other premises with a bar, but combined stakes per premises may not exceed £100 per day.  There is also a limit on prizes of £100 per game and no participation fee may be charged.

The Poker Tree League offers venues two forms of membership to the league.

Points venues play ONLY for points on the poker evening which is not deemed as gaming as detailed in the gambling commission guidelines “Gaming is only covered by the Act if it is played for prizes of money or money’s worth”.

Low stakes
venues play for points AND cash on the poker evening and have more of a legal responsibility for ensuring their poker evening conforms to the Gambling Commission Guidelines.
